The two were students at Mount Sinai High School in Mount Sinai, N.Y. Patent Pending was formed hastily for an open mic. Ragosta pressured his younger brother Michael to sing lead vocals. Ragosta and Buffardi recruited the only drummer they knew, Anthony Mingoia to round out the group.
Patent Pending joined the record label We Put Out Records in 2005. A year later, they released their debut album, Save Each Other, The Whales Are Doing Fine. They rode the success of their first album into an appearance in the entire 2006 Vans Warped Tour. Following the Warped Tour, they joined Gym Class Heroes and Cobra Starship on their respective tours.
