They had previously enjoyed success with the rock bands Katherine, Goners and Perfect P*ssy, though wanted to form a different group that pushed the boundaries of the punk rock genre. In 2016 Empath released their debut EPs Crystal Reality Vols. 1 & 2.
After filling out their lineup, Empath released Liberating Guilt and Fear in 2018 through Get Better Records, which featured production by Greg Saunier of the indie rock band Deerhoof. Later that year they also released Environments, a tribute to artist Irv Teibel. Empath’s Active Listening: Night on Earth LP caught the eye of Fat Possum Records, who promptly signed the band at the end of 2018. Their innovative sound has been compared to groups like Clinic, Neutral Milk Hotel and American Pleasure Club.
